Job Description:

Under the direction of a unit Supervisor, the right of way agent is responsible for all phases of land acquisition activities and provides support to the Land Acquisition unit, other Land team members, and the internal Line of Business team. The Agent negotiates the acquisition of land rights for fee title, easements, leases, licenses, and other interests required for Company utility facilities. The Agent is also responsible for negotiating damage settlements for crop and property damage necessary to accomplish the proposed utility construction. Additional duties may include: support for condemnation actions, completing land and damage valuations for acquisition negotiations, preparing project budgets, coordinating the ordering and review of appraisals by the designated appraisal staff, conducting outreach to impacted property owners for projects that require the acquisition of land rights, recordation of easements, and supporting other internal functions of Land Acquisition.

Once employed as a right of way agent, you may be considered for a senior right of way agent position in the future provided that you meet all of these requirements: possess SR/WA Designation from the International Right of Way Association; California Notary Public– current or obtained within six (6) months of employment.; have 30 months of experience in right of way or equivalent field; and demonstrated satisfactory performance in your current position for a minimum period of 6 months.

Job Responsibilities:

  • Acquisition Administration: Input and manage data related to all acquisition activities in project tracking programs, produce project estimates for acquisition costs, causing deeds to be recorded, and complete closeout checklist items.
  • Contract Administration: Assist with developing scope of work documents, Contract Work Authorizations, Contract Change Orders, or other associated documents as requested to obtain land acquisition related services.
  • Valuation Estimation: Complete valuation estimates for negotiation and budgeting purposes on non-complex, lower-value acquisitions, including those involving damages to crops or real property and perform similar activities for more complex and higher-value acquisitions under the direct supervision of a senior or principal agent.
  • Acquisition: Negotiate or assist in negotiating the acquisition of temporary or permanent land rights and related damage settlements for Company utility facilities, coordinate with Law and Land Rights for the approval of non-standard acquisition documents, research property owners, conduct outreach to property owners for projects that require land acquisition, and process proper payment to grantors.
  • Real Estate/Escrow: Order title reports and updates, obtain title reviews, and coordinate escrow steps to complete land acquisitions.
  • Appraisal Coordination: Assemble documentation required for the designated appraisal staff to order a formal appraisal, communicate changes in project needs or scope that take place after the appraisal order has been initiated, and read and interpret the appraisal report in collaboration with the designated appraisal staff, and then in turn, communicate the key points to a property owner.
  • File Management: Maintain proper project files within designated filing systems and support a data retention system in coordination with the Land Rights Library.
  • Support for Condemnation Proceedings: Provide file history, a contact log or acquisition diary, and complete information for condemnation proceedings, request the condemnation package (also known as a Pink Package) from Land Survey, coordinate with the designated appraisal staff, and deliver a full set of documents, ready for filing, to the Law Department upon review by senior staff; initiate steps in the condemnation process as part of escalated negotiations; serve as an expert witness in condemnation proceedings and participates in pretrial and trial proceedings if requested by the Law Department; request payment for condemnation proceedings, monitor the State Condemnation Fund statement and account, deposit funds with State Condemnation Fund, and process a State Condemnation refund at the conclusion of proceedings.

Job Requirements:

  • California Real Estate Sales Person License
  • California Notary Public-current or obtained within six (6) months of employment.
  • Bachelor’s degree in related field or equivalent education and/or experience
  • 1 year experience in real estate, land acquisition, right of way, appraisal, or any related activities preferably involving eminent domain.
  • International Right of Way Association courses, college or graduate-level Real Estate courses, or equivalent
